El cambio climático llegó hace tiempo para quedarse en Chile.
Desde múltiples sectores se viene planteando la necesidad de un cambio radical en las políticas públicas relacionadas con la biodiversidad, tanto bajo la premisa de gestión de recursos naturales como de conservación de los ecosistemas.
Sin embargo aquello, tanto el gobierno de Sebastián Piñera como legisladores de la derecha, la Sociedad Nacional de Agricultura y el Consejo Minero, se resisten a dar curso a los urgentes cambios requeridos.
Eso es lo que se desprende al contrastar las recomendaciones contenidas en el Informe de la Mesa del Agua constituida al alero del Comité Científico de Cambio Climático con las posturas críticas a la reforma al Código de Aguas que se tramita actualmente en la Comisión de Constitución del Senado.
Lo paradójico es que el Comité Científico de Cambio Climático fue convocado en 2019 por el propio gobierno a través del Ministerio de Ciencia, Tecnología, Conocimiento e Innovación, con miras a la COP25 que en diciembre se realizaría en Santiago.
Aunque finalmente la cumbre ambiental se desarrolló en Madrid, como insumo quedó el documento “Evidencia Científica y Cambio Climático en Chile: Resumen para tomadores de decisiones” que resume los resultados del trabajo de “investigadores de una red de más de 600 científicos de todas las disciplinas y regiones de Chile, primordialmente de universidades y centros de investigación académicos, pero también de institutos públicos y privados”.
Este grupo se organizó en 7 mesas de trabajo: Mitigación y Energía; Adaptación; Agua; Biodiversidad; Ciudades; Criósfera y Antártica; Océanos.
Entre los principales temas cuestionados por el Ejecutivo y los senadores Andrés Allamand (RN) y Víctor Pérez (UDI) están la temporalidad de las nuevas concesiones por un período de 30 años, y la extinción de los derechos cuando las aguas solicitadas no se utilizan en un período determinado (y que hoy solo se grava mediante el pago de una patente) y la caducidad de los que no sean inscritos en el Conservador de Bienes Raíces, con el fin de no pagar patentes por no uso.
Estas materias están en el centro de la reforma, donde el debate es si el agua se mantendrá como propiedad privada perpetua sujeta a mercantilización o estará sujeta a restricciones que permitan su redistribución basada en el bien común, priorizando el consumo humano, las actividades de subsistencia, los usos ancestrales y los ecosistemas.
La voz de la ciencia
En materia de gobernanza e institucionalidad hídrica la Mesa del Agua entrega orientaciones concretas, concordadas por los 156 científicos participantes. En esta labor contó con la colaboración de la Red de Investigación de Recursos Hídricos (Red H20), la cual es coordinada por el Consejo Nacional de Innovación para el Desarrollo (CNID).
En primer término plantea “revisar los métodos utilizados para la asignación de recursos hídricos, incluyendo el concepto de un clima e hidrología cambiantes, a la luz de la experiencia comparada, dotando a la autoridad de la posibilidad de revisar las condiciones originales de otorgamiento de los derechos y entregar mayores atribuciones para enfrentar sequías permanentes y otros eventos extremos, a la luz de la experiencia comparada”.
En este aspecto, algunas de las indicaciones del Ejecutivo se oponen a la posibilidad de restringir el uso de derechos ya constituidos, con el fin de priorizar el consumo humano o la protección de los acuíferos.
Los investigadores agregan la necesidad de “integrar el componente medioambiental al derecho y la gestión de las aguas mediante la aprobación de normas protectoras de glaciares y turberas, nuevas atribuciones y deberes ambientales para la DGA y las organizaciones de usuarios del agua (OUA), e impedir que estas organizaciones administren diferentes secciones de un mismo cauce”.
En este ámbito, el entorpecimiento del gobierno y el Consejo Minero a una Ley de Protección de Glaciares, además de omitir toda mención a estas fuentes de agua cuando en abril de este año la ministra de Medio Ambiente Carolina Schmidt presentó el informe de actualización de la Contribución Nacionalmente Determinada de Chile (NDC, por sus siglas en inglés) de aquí al 2030, para mitigar el cambio climático.
También plantean los científicos “reformar el régimen legal que regula el acceso al agua (propiedad y mercado), en consideración de los usos prioritarios y la mantención de un sistema hidrológico sustentable” y “diseñar un modelo de gestión integrada de los recursos hídricos dentro de una cuenca, mediante la creación de organismos de cuenca con importante rol del Estado y participación de todos los interesados”.
El marco bajo el cual la Mesa del Agua ha hecho sus propuestas es dramático:
“La zona centro-sur de Chile lleva diez años con déficit de precipitaciones de entre 25% y 30%, lo que la convierte en la década más seca desde que existe registro, la cual ha sido atribuida en parte al cambio climático” señalan en la publicación.
Aunque se consideraba que la votación continuara este lunes, la citación de la Comisión de Constitución informa que se abordará el proyecto de reforma constitucional para modificar normas respecto al plebiscito nacional de octubre de 2020.
Tras 9 años de tramitación, la reforma del Código de Aguas deberá esperar un poco más.
