En el referendo de ayer en Chile se jugaba no sólo la aprobación o no de un retrógrado engendro constitucional, sino también un primer ensayo de disposición de fuerzas políticas con vistas a las elecciones presidenciales de noviembre del 2025.
Afortunadamente, el veredicto de las urnas dio al traste con la nueva propuesta constitucional y propinó un duro revés a las expectativas que tenía la derecha neofascista de instalarse en la pole position de la futura carrera presidencial.
Esto porque de haberse producido el triunfo del “A Favor”, el ultra derechista Partido Republicano y su líder, José Antonio Kast, ya habrían dado inicio a la campaña presidencial procurando capitalizar la decisión tomada por el pueblo chileno, profundizando la desorganización y el desconcierto de los sectores democráticos y progresistas.
Ayer mismo, a poco de conocido el resultado, surgieron voces, en muchos casos mal intencionadas: decían que con su voto la población había ratificado la Constitución de Pinochet.
Esa conclusión es no sólo maliciosa sino también errónea porque aquélla no estaba en juego el día de ayer. No puede olvidarse que en el año 2020 el 78 por ciento del pueblo chileno votó por el rechazo a dicho cuerpo constitucional.
Lo que se debía decidir ayer era si la nueva propuesta urdida en las cloacas del poder oligárquico chileno sería aceptada por la población.
El resultado fue categórico: el “En Contra” venció con un 56 por ciento de los votos, pese a las intensas campañas de desinformación, de resignación y de incentivación al ausentismo, lanzadas desesperadamente por la derecha.
El voto es obligatorio ahora en Chile, pero la tasa de participación del 88 por ciento habla a las claras del fracaso de aquella campaña y de la saludable voluntad de participar puesta de manifiesto este domingo.
En pocas palabras, se rechazó una constitución que conculcaba derechos sociales y laborales fundamentales, que bendecía la total mercantilización del medio ambiente, resentía aún más la menguada soberanía nacional sobre los bienes comunes, consagraba la impunidad en materia de derechos humanos y recortaba significativamente los derechos de las mujeres y las diferentes identidades de género.
En suma, se rechazó una propuesta viciada en lo procesal por lo antidemocrático de su gestación y funcionamiento; y en lo sustancial, por su recorte a ciertos derechos y garantías todavía contenidos en la Constitución de 1980, especialmente si se tiene en cuenta que –según un estudio del PNUD sobre los cambios constitucionales a nivel internacional– en el período post-dictatorial, dicha pieza había sido objeto de 69 leyes de reforma. Esto la convirtió en la Constitución más reformada de la historia de Chile.
Producto de esos cambios –que de todos modos mantuvieron la filosofía básica que le imprimiera su reaccionario redactor, Jaime Guzmán Errázuriz– se eliminó el artículo 8° que “proscribía a grupos o partidos de carácter totalitario o fundados en la lucha de clases”, es decir, a los comunistas; también se eliminó la facultad presidencial de exiliar y el requisito de que las reformas constitucionales fuesen aprobadas por dos Congresos consecutivos.
Además se anuló la existencia de senadores designados y vitalicios (9) que se agregaban a los 38 surgidos de la voluntad popular. Y se redujo el mandato presidencial de seis a cuatro años.
Teniendo en cuenta estos antecedentes, la propuesta pergeñada por los libertarios, era un significativo paso atrás que afortunadamente fue abortada por la derrota del “A Favor”.
Chile tendrá que enfrentar en los próximos años la tarea de darse una Constitución genuinamente democrática, depurada de los legados pinochetistas y de las aspiraciones restauradoras y autoritarias de su voraz clase dominante y de la partidocracia que gobierna en su nombre, ninguna de las cuales aceptan la instauración de una democracia digna de ese nombre.
Tal cosa no ocurrirá en lo que resta del mandato de Gabriel Boric, pero es una asignatura pendiente que deberá ser saldada sin mayor demora en el próximo turno presidencial y que exigirá ingentes esfuerzos de concientización y organización a las fuerzas democráticas y populares.
Mientras tanto es hora de festejos. No porque se eligió algo bueno sino porque el pueblo chileno sabiamente evitó que lo malo fuera sucedido por algo mucho peor.
Y de paso, miradas las cosas desde este lado de Los Andes, se evitó que una victoria de la ultraderecha en Chile potenciara el “salvajismo de mercado” del anarcocapitalismo argentino.
