En un giro no inesperado, pues caía de cajón, pero no por ello menos infrecuente y significativo, Angel Valencia, el jabonoso fiscal nacional, destituyó de la investigación de la Fundación PorCultura, al controversial e indebidamente expansivo fiscal regional de Coquimbro, Patricio Ignacio Cooper Monti.
Era que no, despues de que un fallo de la Corte de Apelaciones de Antofagasta, declaró ilegales las resoluciones que autorizaron la medida intrusiva de interceptación telefónica a Josefina Huneeus Lagos y todas las diligencias que de ellas se derivaron.
Josefina Huneeus, es exesposa de Alberto Larraín, fundador de la Fundación ProCultura.
En fallo unánime (causa rol 282-2025), la Primera Sala del tribunal de alzada, integrada por los ministros Virginia Soublette, Jaime Rojas y el fiscal judicial Rodrigo Padilla Buzada, acogió el amparo presentado por la psiquiatra Josefina Hunneus, tras establecer que las resoluciones cuestionadas, dictadas por el Juzgado de Garantía de Antofagasta, son ilegales, arbitrarias e infundadas.
El vedericto, que en forma demás oportuna raya la cancha del ministerio público, en materias altamente sensibles, concomitantes con el espionaje, sentencia que el requerimiento de Cooper para solicitar la interceptación de las comunicaciones de la amparada, incumplió el artículo 222 del Código Procesal Penal, toda vez que, si bien da cuenta de una serie de presupuestos fácticos eventualmente constitutivos de los delitos de fraude al Fisco y lavado de activos, nada indica con relación a «los hechos» por los cuales el fiscal pretende dar por acreditada la concurrencia de «fundadas sospechas» de que la amparada «ha cometido o participado en la preparación o comisión, o que se preparaba actualmente en la comisión o participación en un delito».
Añade que tampoco expone que Josefina Huneeus «hubiese servido de intermediaria de las comunicaciones que verificaban otros imputados», como tampoco que ella «facilitara sus medios de comunicación a otros imputados o sus intermediarios».
Asimismo, nada se expuso en la solicitud, referente a que el éxito de la investigación de esos ilícitos, en lo que atinge a la amparada, «hiciere imprescindible la medida intrusiva requerida».
La resolución establece que no solo se infringió la obligación general de fundamentación ordenada por el artículo 36 del Código Procesal Penal y todos y cada uno de los requisitos y obligaciones que impone el artículo 222 del mismo texto legal, «sino que se han validado actuaciones policiales al amparo de quien dirige la investigación, propias de tiempos pretéritos de la República, donde las garantías fundamentales de los ciudadanos eran vulnerados por agentes del propio Estado».
Por tanto, la Corte acogió el amparo a Josefina Huneeus en contra de las resoluciones dictadas los días 16 de octubre de 2024, 6 de diciembre de 2024 y 10 de febrero de 2025; las que quedan sin efecto solo en lo que concierne a la amparada, declaró su ilegalidad, así como de las referidas decisiones jurisdiccionales, como también de todas las diligencias y resoluciones que de ellas se derivaron, con sus respectivos resultados, «disponiéndose la eliminación en la investigación fiscal de todo lo obtenido en base a los actos cuya ilegalidad acaba de declararse».
En consideración a la contundencia del fallo, es evidente que la remoción de Cooper del caso ProCultura dispuesta por el resbaladizo Valencia, que posa de sus relaciones transversales, como toda sanción, equivale a tarjeta amarilla, debiendo, a todas luces, ser roja. A ver que dice el VAR.
En un pasado no distante, por mucho menos renunciarion los fiscales Carlos Gajardo y Emiliano Arias. A ver si Cooper exhibe esa dignidad.
Escuchas al Presidente: La Herida Invisible del Estado

En mayo de 2025, Chile fue sacudido por una revelación inquietante: las comunicaciones telefónicas del Presidente Gabriel Boric habían sido interceptadas en el contexto de una investigación del Ministerio Público.
A partir de este hecho, surgió una crisis política, jurídica e institucional sin precedentes desde la recuperación democrática. Este artículo ofrece un resumen narrativo, jurídico y político de todo el caso, incluyendo sus implicancias, responsables, y lo que este episodio revela sobre el estado del Estado.
La historia comenzó con una investigación sobre redes de corrupción política, autorizada por un juzgado de garantía. Entre los teléfonos intervenidos, se incluyó, por «error», una línea del entorno del Presidente de la República. Durante al menos cinco días, se registraron llamadas sensibles de alta autoridad sin conocimiento ni notificación a la Corte de Apelaciones ni a la Agencia Nacional de Inteligencia. Parte de estas grabaciones fueron filtradas a la prensa, generando un escándalo nacional.
En el centro de la tormenta se encuentra el fiscal Patricio Cooper. De perfil reservado, Cooper ha estado involucrado en causas de alto voltaje político y es considerado cercano al gremialismo judicial y la ultraderecha. Algunas versiones lo vinculan familiarmente con Alan Cooper, condenado por el asesinato del general René Scheneider e indultado por Pinochet. Su papel protagónico en la autorización y ejecución de la interceptación, así como su aparente tolerancia frente a la filtración de información reservada, han puesto su nombre en la línea de fuego.
El primer fallo de la Corte de Apelaciones
El pasado 3 de mayo, la Corte de Apelaciones de Antofagasta emitió un fallo sin precedentes, al acoger un recurso de amparo preventivo. El tribunal estableció que la interceptación al presidente Boric fue ilegal, desestimó la tesis del error numérico como excusa suficiente, y ordenó una serie de medidas urgentes, incluyendo la entrega de la nómina de líneas interceptadas y la evaluación parlamentaria de acusaciones constitucionales contra los funcionarios involucrados.
El fallo dividió opiniones, pero marcó un hito. La Corte destacó que la protección de las comunicaciones del jefe de Estado constituye una salvaguarda institucional esencial.
Las leyes que regulan las interceptaciones telefónicas en Chile son claras: requieren orden judicial específica, control estricto y, en el caso de autoridades de Estado, salvaguardias reforzadas.
Las violaciones detectadas en este caso incluyen posible abuso de funciones, prevaricación, infracción a deberes públicos y violación del secreto.
Además, la investidura presidencial exige un estándar máximo de inviolabilidad que no fue respetado.
Implicancias Políticas e Institucionales
El oficialismo reaccionó con indignación. La oposición, con cautela.
Desde La Moneda se habló de una «operación encubierta» para debilitar al gobierno.
La Cámara de Diputados abrió una comisión investigadora.
La ANI, en entredicho, fue llamada a modernizar sus mecanismos de control.
La Fiscalía Nacional quedó debilitada, y se abrió un debate sobre la necesidad de una reforma estructural.
El caso dejó al descubierto fallas críticas en la coordinación entre organismos del Estado. La inexistencia de una base consolidada de líneas críticas, la falta de protocolos para corregir errores en tiempo real, y la inexistencia de auditorías automáticas generaron un cóctel de vulnerabilidad institucional.
Propuestas de reforma
La prensa internacional cubrió el caso con moderación, aunque diplomáticos de varios países solicitaron reportes reservados. En Chile, la sociedad civil se mostró dividida: algunos vieron el caso como una muestra de descomposición institucional; otros, como una oportunidad para reformar el aparato del Estado.
Entre las medidas propuestas destacan:
Modificar la Ley 19.974 para incluir protocolos especiales en casos de autoridades.
Crear una Unidad de Validación de Líneas Críticas en la ANI.
Imponer registros de auditoría obligatorios en toda interceptación.
Fortalecer el control parlamentario del Ministerio Público.
Fallo contundente
El 16 de mayo, la Corte de Apelaciones de Antofagasta volvió a irrumpir en la escena nacional al acoger un recurso de amparo presentado por la defensa de Josefina Huneeus, exesposa del fundador de la Fundación ProCultura. En dicho fallo, el tribunal declaró ilegales las interceptaciones telefónicas practicadas por el fiscal Patricio Cooper, entre las cuales figuraba una conversación privada con el presidente Gabriel Boric.
La Corte argumentó que las autorizaciones judiciales utilizadas eran genéricas, sin motivación específica ni conexión directa con los hechos investigados. Asimismo, se ordenó excluir del expediente toda evidencia derivada de dichas escuchas, por vulneración del derecho a la inviolabilidad de las comunicaciones y al debido proceso.
Horas después del fallo, el Fiscal Nacional Ángel Valencia anunció la remoción de Patricio Cooper de la causa ProCultura. Explicó que la decisión obedecía a la necesidad de proteger la objetividad y continuidad de la investigación, frente a la gravedad del precedente judicial.
El caso fue asignado a la Fiscalía Regional de Antofagasta, a cargo del fiscal Juan Castro Bekios.
Cooper, por su parte, fue instruido para elaborar un informe detallado con respuesta a las observaciones de la Corte, en especial respecto a la demora en identificar que la línea intervenida correspondía a Huneeus, y no a Alberto Larraín, blanco original de la investigación.
Hasta la fecha, el fiscal Patricio Cooper no ha emitido declaraciones públicas.
Reacciones políticas
La remoción provocó diversas reacciones en el ámbito político. .
El oficialismo, especialmente sectores del Frente Amplio, valoró la decisión como «una señal institucional necesaria».
El Partido Comunista acusó «uso ideológico de las herramientas investigativas».
En las antípodas, el Partido Nacional Libertario calificó de «politización del Ministerio Público» y defendió la labor de Cooper.
Juristas y analistas advirtieron que la sentencia de la Corte no sólo afecta el caso ProCultura, sino que podría extenderse como precedente a otras causas donde las escuchas fueron autorizadas con igual laxitud.
En paralelo, el Senado discute una reforma a la Ley Orgánica del Ministerio Público para reforzar los mecanismos disciplinarios y establecer límites más precisos al uso de medidas intrusivas.
Reincidencia
No es primera vez que el fiscal Cooper es relevado de un caso, y por las mismas razones.
En marzo de 2025, Valencia apartó a Cooper de la investigación relacionada con la filtración de chats entre la diputada Karol Cariola y la exalcaldesa de Santiago, Irací Hassler.
Estos mensajes, obtenidos mediante el sistema forense Cellebrite Reader, fueron filtrados a la prensa, lo que generó una fuerte polémica.
La filtración ocurrió en el contexto de la investigación del caso Sierra Bella, donde se indagaban presuntos delitos de tráfico de influencias y otros ilícitos.
Según la fiscalía, la decisión de remover a Cooper se tomó para garantizar la objetividad y el adecuado desarrollo de las diligencias en curso. La fiscal regional de Valparaíso, Claudia Perivancich, fue designada para continuar con esta investigación .
La remoción de Cooper se produjo tras críticas por el manejo de las diligencias, incluyendo el allanamiento al domicilio de la diputada Cariola el mismo día que dio a luz, lo que fue considerado una vulneración de derechos.
Además, se le acusó de filtraciones y omisión de perspectiva de género en su actuar. Estos antecedentes llevaron a parlamentarios a solicitar su destitución ante la Corte Suprema .
En resumen, Patricio Cooper fue removido de dos investigaciones de alto perfil: primero, de la arista Sierra Bella por la filtración de chats y cuestionamientos a sus procedimientos, y posteriormente, del caso ProCultura tras un fallo judicial que declaró ilegales ciertas diligencias intrusivas.
El caso ha vuelto a plantear una pregunta de fondo: ¿puede el Ministerio Público actuar con autonomía plena sin mecanismos de control más rigurosos?
La respuesta, aún en debate, marcará el devenir de las relaciones entre poder político, justicia y ciudadanía en los próximos años.
Con todo, el caso de las escuchas al presidente Boric, sumado a la remoción del fiscal Cooper de los casos ProCultura y Sierra Bella, no son eventos aislados.
Constituyen manifestaciones convergentes de una crisis más profunda en la institucionalidad investigativa del país.
La vulneración de derechos, la instrumentalización política de la justicia y la carencia de controles internos robustos son síntomas que no deben ser ignorados.
Lo que está en juego, más allá de responsabilidades individuales, es la legitimidad de las instituciones encargadas de investigar y juzgar delitos en una democracia moderna.
