El Partido Comunista emplazó al Ministerio Público a remover la fiscal Giovanna Herrera. del caso Farmacias Populares, al tomar conocimiento de declaraciones del ex Secretario Ejecutivo de Achifarp, Matías Muñoz, quien denunció presiones de la fiscal, con el fin de obtener declaraciones falsas, que inculparan a Daniel Jadue.
En entrevista a radio Bío Bío, Muñoz Becerra, uno de los principales imputados en la causa, aseguró que la fiscal Giovanna Herrera Andreucci le ofreció liberarlo de prisión preventiva si testificaba que estuvo presente en la supuesta reunión donde se habría verificado el cohecho, el 1 de julio de 2020, en la Municipalidad de Recoleta.
“Lo primordial era cagarse a Jadue”, agregó.
En tal contexto, ratificó un aspecto que Jadue ha sostenido de modo inalterable, relativo a que, por estatutos, no le correspondía intervenir en la gestión:
«Él siempre fue el presidente de la Asociación, en espacios laborales él era el jefe. Entonces, estaba esa relación de confianza pero él daba las instrucciones generales en base a decisiones políticas y las decisiones comerciales eran mías. El alcalde te dice por ejemplo, necesito que haya una farmacia popular para que todos puedan acceder. ¿A quién contrato? ¿Cuánto le pago? ¿Cómo compro? Es una decisión mía. En el día a día de las compras y ventas Jadue no existía. Y funcionaba. La Asociación debería haber seguido funcionando si Best Quality hubiese aceptado el trato de pago que hicimos en enero de 2022». .

Muñoz Becerra se refiere a una reunión entre Rodrigo Aros, abogado de Achifarp; Mario Vargas y Eduardo Lagos, abogados de Best Qualty, César Ramírez vendedor de la misma y el prestamista y financista de Best Quality, Fernando Cassorla, en la oficina de Eduardo Lagos, en Las Condes.
«Ahí les dijimos que podíamos dividir las cuotas en alrededor de 25 millones de pesos mensuales, que es lo que podíamos hacer. Si se hubiese dejado que la Asociación funcionara y que los municipios pagasen, no hubiésemos tenido ningún problema y hubiésemos tenido pagada toda la deuda hace dos años. Pero la respuesta fue categórica, y yo también lo dije en la primera declaración: “A nosotros no nos interesa la plata, a nosotros nos interesa cagarnos a Jadue”.
Lo que agrega Muñoz Becerra es gravísimo, y por tanto, no puede no investigarse con rigor; a fin de cuentas, es un asunto de justicia:
«Cuando estuve preso y tuve que declarar, la fiscal literalmente me dijo “dígame que usted estuvo en una reunión con Jadue, que Best Quality le ofreció plata, le vendieron las mascarillas y que el que negoció fue Jadue” y me ofreció a cambio salir en libertad. Yo declaré un 27 de septiembre y el 2 de octubre estaba afuera. Entonces lo que yo hice fue ir y decirle lo que días antes Moraga también había declarado en contra de Jadue: que yo estuve en esa reunión, que él negoció y que pidió esa plata. Pero yo nunca estuve en esa reunión porque esa reunión no existió. No hubo negocio, no hubo cohecho. Las muestras de georeferenciación dicen que no estaban ahí, no hay pruebas, no hay cámaras de grabación. Y me tocó mentir. Y yo lo declaro porque ella me dice literalmente “y no lo voy a imputar por ese cohecho, asi que no se preocupe”. Me ofreció que si mentía podía salir en libertad. También quería que dijera que las platas del autopréstamo me las robé y se las pasé a Jadue, eso yo no lo hice».
Si una investigación justa demuestra la veracidad de las acusaciones de Muñoz Becerra, la fiscal Herrera no sólo debe ser removida del caso Achifarp, sino también destituida del Ministerio Público y sometida a proceso, por numerosos delitos funcionarios; entre ellos, prevaricación, cohecho, tráfico de influencias y abuso de funciones.
De una parte, el débil fundamento jurídico de la acusación de la fiscala, emerge por el absurdo de que Daniel Moraga, primer secretario general de Achifarp, autor material de la secuencia de compras y ventas con Best Quality, origen al caso, mismo que endeudó a la asociación por cerca de $3.000 millones, de una parte, por excesos de gastos innecesarios, y de otra, por pagos sin respaldo, y confeso de haber desviado fondos a sus cuentas personales, anda libre por la vida, con oferta de juicio abreviado, lo que garantiza pena remitida, mientras que Daniel Jadue, inculpado por declaraciones falsas, de César Ramírez, Daniel Moraga y Matías Muñoz, permaneces privado de libertad desde el 20 de mayo de 2024; es decir, un año y 61 días, acerca de una deuda que estaba cancelada en cerca del 50%, y en proceso de negociación.
De otra, las escasa calidad técnica de la investigación tiene a la fiscala atrapada en su propia trampa. En un elevado porcentaje, las resoluciones y diligencias de la carpeta investigativa están concentradas y orientadas en dirección a todo antecedente o elemento que perjudique a Jadue. En cambio, muy pocas, casi ninguna, de aquellas solicitadas por la defensa de Jadue, las cuales, por mandato constitucional y el principio de la objetividad, está obligada a cumplir.
Resultado neto: no logró cerrar la investigación y acusar, y por tanto, no pudo impedir la candidatura de Jadue a diputado por el noveno distrito, que, de otra parte, tiene alta posibilidad de ganar.
Como fuere, el Partido Comunista emitió una declaración pública, acerca de las declaraciones de Muñoz.
Declaración pública
Ante las revelaciones periodísticas en relación a la investigación penal que involucra al compañero Daniel Jadue el Partido Comunista de Chile se hace el deber de señalar lo siguiente:
1. Como Partido Comunista hemos sostenido siempre la total inocencia de Daniel Jadue, quien fuera encausado por diversos delitos en su calidad de Presidente de la Asociación Chilena de Municipalidades con Farmacias Populares. ACHIFARP era una entidad que agrupaba a municipios que habían implementado farmacias populares para ofrecer medicamentos a precios justos. Esta iniciativa nace ante la colusión en los precios de las farmacias tradicionales, que afectaba el acceso a éstos, fundamentalmente en los sectores populares.
2. Hoy se confirma que el ánimo de la Fiscalía ha sido siempre dañar la reputación personal y política de nuestro compañero Daniel Jadue, menoscabando su imagen pública y el proyecto político antineoliberal que se estaba desarrollando desde el territorio, la comuna de Recoleta. La arbitraria e ilegal persecución penal tenía como propósito socavar su posición política, no lograr una condena penal. La Fiscalía logró privar de libertad al alcalde Jadue el tiempo suficiente para que perdiera su calidad de edil de la Municipalidad de Recoleta, manteniendo hasta el día de hoy la medida cautelar de arresto domiciliario y de incautación de sus bienes.
3. La reciente declaración de Matías Muñoz a un medio de comunicación, Radio Bio-Bio, es demostrativa de la falta objetividad e imparcialidad de la Fiscal Giovanna Herrera Andreucci, al sostener que fue presionado para emitir declaraciones falsas que inculparan a Daniel Jadue. Señala que le ofrecieron sacarlo de la prisión preventiva, en la que se encontraba hace más de 100 días, si declaraba que estuvo presente, y que Daniel Jadue había participado, en la supuesta reunión en que se habría planificado el cohecho.
4. Atendida la gravedad de los hechos revelados en la entrevista, emplazamos al Ministerio Público a que remueva del caso a la Fiscal Giovanna Herrera. Además de las declaraciones emitidas a la prensa el día de hoy por Matias Muñoz, la Fiscal se encuentra en calidad de querellada por el delito de prevaricación, por estos antecedentes y por el evidente conflicto de intereses debido a su relación de parentesco por afinidad con quien ha desarrollado un proyecto similar a farmacia populares pero financiado por grandes empresas, «Farmacias SQM Fracción». Ahora el coimputado Matías Muñoz denuncia coacciones indebidas para inculpar al ex alcalde Daniel Jadue.
5. El Partido Comunista busca que se garantice la transparencia en la persecución penal, y la adhesión del proceso penal chileno a un sistema democrático en que se cumplan los estándares de objetividad, imparcialidad e independencia de las instituciones de justicia, principalmente del ente persecutor, el Ministerio Público. En suma, se exige el respeto irrestricto al Estado Democrático de Derecho.
En el contexto de una serie de hechos que involucran en la actualidad a las Fiscalías, de sumarse esta denuncia, reviste la máxima gravedad y obliga a adoptar medidas acordes con la seriedad de los hechos denunciados.
